Will Apple take my Iphone 4 if i take it in for repair

Hi i recently bought a iphone 4 claimed faulty with software problems. The mobiles still under warranty and apple said they will replace the phone but i wanted to know if apple will take the phone off me If i take it to the genius bar. Incase its been claimed on insurance as i dont know if it is. I cant test the phone so i cant check if its claimed or not. Im in UK by the way.

If they replace under warranty, then they will take your iphone and give you another.
