if i cant get this sorted ima beat the woman that did this and slap her arse onto working the streets... only kidding but i really do need some help with this one!

Well, since you cant delete songs directly form the iPhone, you might want to find someone else to lay a beating on. My first instinct would be to blame the person that wasnt technical enough to back the music up on the computer.

Unlike apps, music is a one-time download. Its your responsibility to maintain a backup of your iTunes purchases. You can contact iTunes support, plead your case and hope for the best:

and i know you can delete music. she reset my phone to default settings. like everything went.

Its not the wifes fault that YOU never bothered to backup your content. Thats your fault and consider it a lesson in why you should back up your stuff. Music is a one time download.

It is important to make sure your purchases as you buy one and only one download.
It has always been very basic to backup your computer files/docs/pics/music/etc.
Sorry that your music is gone, but this will happen if you fail to do the basics.
As provided, you can try asking for an exception. Maybe they will allow in your case.
