Im having trouble finding the tethering setting i have looked in general, network but then there is nothing in there about Tethering. Any ideas why this may be?

Does your carrier support tethering and if so, do you have a tethering package established for your iPhone with your carrier?

I cannot find it either and ATT tech has no idea why. What options do I have to get this resolved?

Same for me, among other issues with 4.3. I have tethering.

ATT now supports tethering. Initial plan is 4G @ 45$ per month and enables tethering (Personal hotspot). When activated by the carrier, your tethering option becomes a personal hotspot feature.
I activated the service and found it worked well with my computers pairing through bluetooth or using the USB cable.
Be forewarned - the bluetooth pairing DOES NOT work with other IOS devices. IOS devices cannot pair, therefore you cannot use a 3GS phone as a hotspot for an iPad. Nor can you physically connect an iPhone with an iPad.
If you have an iPhone 4, it broadcasts the carrier data feed as a wifi signal detectable by your other devices. No bluetooth conflicts to be concerned with.
