iPhone 4 back from repair scratches

Earlier in the week i sent my iPhone 4 of for repair to apple care. I had problems with the screen being sometimes unresponsive and the battery holding charge for about a day with no apps being played. Anyway apple sent my phone back with a letter explaining that they could not reproduce these symptoms so i had the same phone. Before i sent my phone off it was in an invisible shield so it only had one or two scratches on the front and back, but now its covered in scratches, what should i do ?

sounds to me like you got a refurbish phone rather then the org one back
hard to prove unless you kept the mac address of the org device to compare with the one that got back

But it has the same serial number ? and they even said in the letter and on the repair status that the original product has been returned. Its quite annoying how i sent it in perfect condition and now its covered in scratches
